Terms Of Service

Agreement

These Terms of Service (“Terms”) govern your access to and use of the RORO TRUCK website at rorotruck.my, the RORO TRUCK mobile applications, and the RORO bin rental and waste collection services provided through them (together, the “Services”).

The Services are operated by Simatex United Sdn Bhd (Company No. [SSM registration no.]), a company incorporated in Malaysia (“we”, “us”, “our”). By creating an account, placing a booking or otherwise using the Services, you agree to be bound by these Terms, our Privacy Policy, our Shipping & Delivery Policy and our Return & Refund Policy. If you do not agree, do not use the Services.

Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract. If you use the Services on behalf of a company or organisation, you confirm that you are authorised to bind that entity, and “you” refers to that entity.

Your Account

• You must provide accurate, current and complete information when registering and keep it up to date.
• You are responsible for keeping your account credentials confidential and for all activity under your account.
• Notify us immediately of any unauthorised use of your account.
• We may suspend or close an account that contains false information or is used in breach of these Terms.

Bookings

• A booking placed through the app or website is an offer to purchase the Services. A contract is formed only when we confirm the booking and payment is successfully authorised.
• You must accurately declare the type of waste, the bin size required, the delivery address and any site access restrictions. Incorrect information may result in a failed delivery, additional charges or refusal of service.
• We may decline or cancel a booking where the waste is prohibited, the site is unsafe or unlawful to service, the required local authority permit is absent, no operator is available, or we suspect fraud.

Pricing And Payment

• All prices are in Malaysian Ringgit (MYR / RM) and are displayed in full before you confirm a booking.
• Prices include delivery, placement and collection within the standard coverage zone unless stated otherwise. Distance surcharges, extension days, overload, wasted-trip and prohibited-waste charges are additional and are set out in the Delivery Policy.
• Payment is collected through licensed third-party payment gateways. We do not store your full card or online banking details.
• Where applicable, prices are inclusive or exclusive of government taxes as indicated at checkout, and tax is charged at the prevailing statutory rate.
• We may change prices at any time. The price applicable to your booking is the one confirmed at checkout.
• Overdue amounts on credit or corporate accounts may attract late payment charges and suspension of service.

Cancellations And Refunds

Cancellation windows, refundable and non-refundable charges, and refund processing times are set out in full in our Return & Refund Policy, which forms part of these Terms.

Your Responsibilities

• Provide safe, legal and unobstructed access for the truck to deliver and collect the bin.
• Obtain any permit or permission required by the local authority (PBT) where the bin will stand on a public road or shared space.
• Load the bin level with its rim, within the weight limit, and never with prohibited or scheduled waste.
• Keep the bin secure and reasonably protected while it is on your site, and not move, modify, paint or transfer it.
• Ensure no person burns waste in, climbs on, or otherwise misuses the bin.
• Comply with all applicable environmental, safety and local authority laws relating to the waste you dispose of.

Prohibited Waste

Scheduled, hazardous and other prohibited waste must never be placed in a bin. The full list appears in our Shipping & Delivery Policy. You are responsible for all costs, penalties and losses arising from prohibited waste found in a bin booked by you, and you remain the legal generator of that waste.

Bins Remain Our Property

Every bin remains the property of Simatex United Sdn Bhd or the assigned operator at all times. You acquire no ownership, lien or security interest in it. You are liable for loss of or damage to a bin while it is in your possession, beyond fair wear and tear, at replacement or repair cost.

Role Of Operators

Some deliveries are performed by independent RORO truck operators who use our platform to receive jobs. Where an operator is engaged, we remain your point of contact for the booking, but operators are independent contractors and not our employees. Operators must meet our verification requirements and comply with applicable licensing and road transport law.

Acceptable Use Of The Platform

You agree not to: use the Services for any unlawful purpose; interfere with or disrupt the platform; attempt to gain unauthorised access to any system or account; scrape, copy or reverse engineer any part of the Services; submit false bookings; or impersonate another person or entity.

Intellectual Property

The RORO TRUCK name, logo, apps, website, text, graphics and software are owned by or licensed to Simatex United Sdn Bhd and protected by Malaysian and international intellectual property law. You may not copy, reproduce, distribute or create derivative works from them without our prior written consent.

Limitation Of Liability

To the maximum extent permitted by law:

• The Services are provided on an “as is” and “as available” basis. We do not warrant uninterrupted or error-free operation of the website or apps.
• We are not liable for indirect, incidental, special or consequential loss, including loss of profit, revenue, contracts, production time or business opportunity.
• We are not liable for damage to driveways, paving, kerbs, drains, underground services or private roads caused by placing or lifting a bin at a location directed by you.
• Our total aggregate liability arising out of or in connection with any booking is limited to the amount you paid for that booking.
• Nothing in these Terms excludes liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded.

Indemnity

You agree to indemnify and hold us, our employees and our operators harmless against claims, losses, fines, penalties and costs (including reasonable legal fees) arising from your breach of these Terms, your disposal of prohibited waste, your failure to obtain a required permit, or your negligent or unlawful acts.

Force Majeure

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including severe weather, flooding, fire, accident, road closure, traffic restriction, disposal-site closure, industrial action, epidemic, act of government or local authority, or failure of utilities or communications networks.

Suspension And Termination

We may suspend or terminate your access to the Services immediately if you breach these Terms, provide false information, fail to pay amounts due, or use the Services unlawfully. You may stop using the Services at any time. Termination does not affect rights and obligations accrued before it takes effect.

Third-Party Services

The Services rely on third-party providers including payment gateways, mapping services and app stores. Your use of those services may also be governed by their own terms. We are not responsible for their availability or performance.

Changes To These Terms

We may amend these Terms from time to time. The current version is always published on this page and takes effect when posted. The version in force at the time a booking is confirmed governs that booking. Continued use of the Services after a change constitutes acceptance of the amended Terms.

Governing Law And Jurisdiction

These Terms are governed by and construed in accordance with the laws of Malaysia. You and we submit to the exclusive jurisdiction of the courts of Malaysia. We encourage you to contact us first so that any dispute can be resolved amicably.

General

• Severability: if any provision is held invalid or unenforceable, the remaining provisions continue in full force.
• No waiver: failure to enforce any provision is not a waiver of our right to do so later.
• Entire agreement: these Terms, together with the Privacy, Delivery and Refund policies, form the entire agreement between you and us regarding the Services.
• Language: in the event of inconsistency between the English and Bahasa Malaysia versions, the English version prevails.
